Terms of Use

These Terms of Use are a contract between you and Cobalt Simulations for Cobalt Companion, Cobalt Bridge, Cobalt Peak, cobaltsim.com, and related APIs and Relay. If you do not agree, do not use the services. The End User License Agreement also applies to the software. The Privacy Policy describes data handling.

1. Definitions

“Companion” is the Cobalt mobile app (iOS today, plus any other Companion clients we publish). “Bridge” is the desktop program that reads your simulator on a PC you control. “Relay” is Cobalt’s away-from-home connection (relay.cobaltsim.com), included with Peak. “Peak” is the optional paid plan sold on cobaltsim.com via Stripe. “Services” means all of the above plus the website and API.

2. Eligibility and accounts

You must be able to form a contract where you live. Keep your password confidential. You are responsible for activity on your account. One person, one account unless we agree otherwise. Use the same email for Companion and Peak checkout. You may use Companion as a guest on one device; guest data is not a substitute for an account if you want Peak or sync.

3. The services

Cobalt is a companion for simulated civilian flight (Microsoft Flight Simulator 2020/2024 and X-Plane 11/12 as we support them). Features include a live map with VATSIM/IVAO overlays, logbook and Atlas, systems monitoring, Live Activities, widgets, Watch glances, community, and (with Peak) remote systems and camera, ATC inbox via your network client plugin, full history and playback, arrival forecast, airport ops, leaderboard, extra Bridge seats, and Relay. Features change as we ship. We do not promise compatibility with every aircraft, add-on, OS, plugin, or network client.

Bridge must be installed on the sim PC. On the same Wi-Fi, Companion discovers it via Bonjour. Peak Relay is for when you leave that network. Do not port-forward Bridge to the public internet.

4. Peak billing

Peak is sold on the web through Stripe, not as an Apple In-App Purchase on the Companion paywall. Current list prices (USD, before tax, subject to change at checkout): about $9.99 per month, $79.99 per year, and $199.99 lifetime. Recurring plans renew until you cancel in Manage Peak or the Stripe portal; you keep Peak until the end of the paid period. Lifetime is a one-time license to Peak features for as long as we offer the service — not a promise that Cobalt will exist forever, and not a transferrable property interest in our company.

Taxes may be added by Stripe Tax. Chargebacks, fraud, or sharing an account/code may end access. Refunds follow Stripe, card-network, and applicable consumer law; email reports@cobaltsim.com if checkout went wrong. Creator promo codes only apply when Stripe accepts them at checkout.

5. Bridge licenses

Peak includes a Bridge activation code, licensed not sold, default limit three PCs per account. The code is as sensitive as a password. We may rotate or revoke it for abuse. Face ID in the app only hides the code on the device; it is not a second legal license.

6. License to you

We grant a personal, non-exclusive, non-transferable, revocable license to use Companion and Bridge for your own flight-simulation hobby or similar non-commercial use, subject to these Terms and the EULA. You may not reverse engineer except as a law (such as EU interoperability rules) cannot be waived; scrape our API at scale; resell seats; or wrap Cobalt as someone else’s product.

7. Acceptable use

  • Use Cobalt only with simulators, add-ons, and networks you are allowed to use.
  • Do not attack, overload, or probe the API, Relay, Bridge of others, or other users.
  • Do not impersonate controllers or pilots on VATSIM, IVAO, or in Cobalt community.
  • Do not post unlawful, harassing, sexual involving minors, or infringing content.
  • Do not share activation codes, session tokens, or passwords.
  • Do not use Cobalt to operate or navigate a real aircraft.

VATSIM, IVAO, and other networks have their own rules. Breaking them with a tool that talks to Cobalt is still on you. We may suspend accounts that create risk for the networks or for us.

8. Your content

You keep rights in logs, photos, and posts you create. You grant Cobalt a worldwide license to host, process, and display them as needed to operate the features you use, including public pages. You can delete posts or your account; caches, backups, and copies already shared can linger for a short time. You represent you have the rights to content you upload.

9. Third-party services and trademarks

Cobalt is not affiliated with, endorsed by, or sponsored by Microsoft, Xbox Game Studios, Asobo, Laminar Research, VATSIM Inc., IVAO, Navigraph, Navigraph’s data providers, SimBrief / Navigraph LLC, Giphy, Discord, Apple, or any airline, airport, or aircraft manufacturer. Those names appear only to describe compatibility or overlay data. Their terms apply to their services.

10. Simulation disclaimer

Cobalt is entertainment and training for simulated flight only. It is not certified for real-world aviation, dispatch, or navigation. Charts, weather, ATC, traffic, ETAs, and airport intelligence can be wrong, delayed, or incomplete. You are responsible for how you use the sim.

11. Intellectual property

The Cobalt name, dart mark, app, Bridge, and site design are ours or our licensors’. Simulator software, navigation data, airline liveries, and network clients remain their owners’. Feedback you send may be used to improve Cobalt without obligation to you.

12. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULL EXTENT PERMITTED BY LAW WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

13. Limitation of liability

TO THE FULL EXTENT PERMITTED BY LAW, COBALT SIMULATIONS AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, SIMULATOR TIME, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF TWENTY U.S. DOLLARS (US $20) OR THE AMOUNTS YOU PAID US FOR PEAK IN THE TWELVE MONTHS BEFORE THE CLAIM. Some places do not allow these limits; they apply to the maximum allowed. Nothing here limits liability that cannot be limited (for example death caused by negligence where that cannot be excluded).

14. Indemnity

If your use of the Services, your content, or your violation of these Terms causes a claim against us, you will indemnify Cobalt Simulations against reasonable losses and costs, to the extent permitted by law.

15. Termination

You may stop using Cobalt and delete your account at any time. We may suspend or close accounts that violate these Terms, unpaid Peak where access depends on it, or idle accounts we reasonably need to retire. Provisions that should survive (license restrictions, disclaimers, liability, indemnity, governing law) survive.

16. Changes

We may change the Services and these Terms. Continued use after the updated date means you accept the new Terms, except where the law requires extra consent. If you do not agree, stop using the Services and delete your account.

17. Governing law

These Terms are governed by the laws of the United States, excluding conflict-of-law rules, unless your local consumer law requires otherwise (in which case that law applies to those mandatory rights). Courts of competent jurisdiction in the United States may hear disputes, except where consumer law lets you sue in your home country. UN Convention on Contracts for the International Sale of Goods does not apply.

18. Entire agreement

These Terms, the Privacy Policy, the EULA, and any Peak checkout terms Stripe shows form the agreement. If a section is unenforceable, the rest remains. We may assign the agreement in a merger or sale of the project; you may not assign it.
